{"id":4082,"date":"2022-11-25T14:24:37","date_gmt":"2022-11-25T12:24:37","guid":{"rendered":"https:\/\/pradagayoso.com\/?p=4082"},"modified":"2023-01-27T14:26:33","modified_gmt":"2023-01-27T12:26:33","slug":"financial-institutions-external-incentives-help-smes-likely-insolvency","status":"publish","type":"post","link":"https:\/\/pradagayoso.com\/en\/news\/financial-institutions-external-incentives-help-smes-likely-insolvency\/","title":{"rendered":"\u2018Financial institutions should have external incentives to help SMEs at likely risk of insolvency\u2019"},"content":{"rendered":"<style type=\"text\/css\"><\/style>\n<section class=\"kc-elm kc-css-3714674 kc_row entradilla\">\n<div class=\"kc-row-container  kc-container\">\n<div class=\"kc-wrap-columns\">\n<div class=\"kc-elm kc-css-62214 kc_col-sm-12 kc_column kc_col-sm-12\">\n<div class=\"kc-col-container\">\n<div class=\"kc-elm kc-css-3293665 kc_text_block\">\n<p class=\"smallTitle-desc\">PradaGayoso partner F\u00e9lix Salgado participated as a speaker at the Aranzadi Spanish Convention for Insolvency Law<\/p>\n<\/div>\n<div class=\"kc-elm kc-css-3367121 kc_shortcode kc_single_image\">\n<p>        <img decoding=\"async\" src=\"https:\/\/pradagayoso.com\/wp-content\/uploads\/2022\/11\/foto-felix-salgado-congreso-aranzadi-nov22.jpg\" class=\"\" alt=\"\" \/>    <\/div>\n<div class=\"kc-elm kc-css-3932381 kc_text_block\">\n<p>In the opinion of lawyer and PradaGayoso partner <a href=\"https:\/\/pradagayoso.com\/en\/equipo\/felix-salgado-suarez\/\">F\u00e9lix Salgado<\/a>, financial institutions should be given external incentives to help SMEs in a likelihood of insolvency intending to negotiate a restructuring plan with creditors.<\/p>\n<p>As described in the amendment to the consolidated Insolvency Act, a company is in a likelihood of insolvency when it foresees that, in two years\u2019 time, it will be generally unable to pay its debts when due if it does not restructure timely.<\/p>\n<p>In his speech at the Aranzadi Spanish Convention for Insolvency Law, F\u00e9lix Salgado said that the revised insolvency legislation brings about \u2018a change in the rules of the game\u2019 and compels creditors to \u2018do their part\u2019 so that debtor companies may arrive at a restructuring plan at an early stage.<\/p>\n<p>However, in his opinion, financial creditors will need \u2018external incentives\u2019 to assist SMEs in a likelihood of insolvency, since they \u2018will not do that on their own initiative\u2019. In this respect, he suggested making the regulations on bank provisions more flexible, as well as implementing a code of good practice \u2013to which financial institutions may adhere\u2013 to be applied to business restructurations.<\/p>\n<p>F\u00e9lix Salgado also referred to the \u2018huge uncertainty\u2019 surrounding the position of bank loans guaranteed by the ICO (Spanish Official Credit Institute) in a business restructuring scenario. \u2018Banks will need the approval of the Collection Department of the Spanish Tax Agency in order to be able to resolve to accept a restructuring plan; however, we still don\u2019t know the criteria that this Agency will follow\u2019, he added.<\/p>\n<p>Another subject addressed by PradaGayoso partner is the role to be played by a Court with respect to the new restructuring plans. In his opinion, \u2018the Court has a wider involvement than could be expected\u2019, since a court clerk (<em>letrado de la Administraci\u00f3n de Justicia<\/em>) may institute 16 court proceedings (<em>diligencias<\/em>) and a decree; a judge may issue 8 orders (<em>providencias<\/em>), 22 rulings (<em>autos<\/em>) and 6 judgements (<em>sentencias<\/em>); and proceedings may be escalated to the provincial court in 8 events.<\/p>\n<p>In the opinion of F\u00e9lix Salgado, such a large number of court decisions may hinder in practice the negotiation of a restructuring plan, in view of the work overload of Spanish courts.
